2. Nature of the services
HEJI FITNESS, INC., operating as The Dad Bod Mechanic, provides fitness coaching: strength and mobility programming, nutrition coaching, and accountability support, delivered in person in Calgary or online.
This is coaching. It is not physiotherapy, and it is not medical treatment.
Jimmy Hartley holds a Bachelor of Kinesiology from the University of Calgary and is a Medical Exercise Specialist. He is not a physician, physiotherapist, dietitian, or registered health professional, and nothing provided here is medical advice.
We do not diagnose, treat, cure, rehabilitate, or manage any injury, illness, or medical condition. We build training that works around what your body is already dealing with. Where a condition needs clinical care, that stays with your own healthcare practitioner.
You should consult a physician before beginning any exercise or nutrition program, particularly if you have an existing medical condition, are taking medication, or have not exercised recently. If your physician advises against something in your program, follow your physician.
3. Assumption of risk
Exercise carries inherent risk, including muscle strain, joint injury, cardiac events, and in rare cases serious injury or death. Nutrition changes can affect existing medical conditions and interact with medication.
You participate voluntarily and you accept those risks. You agree to:
- Disclose relevant health conditions, injuries, and medications honestly and keep us updated
- Stop immediately and seek medical attention if you experience pain, dizziness, chest discomfort, or shortness of breath
- Work within your capability and not attempt anything you feel is unsafe
You are responsible for your own safety during unsupervised sessions.
4. Results
Results depend on factors outside our control, including your adherence, sleep, stress, genetics, medical history, and starting point.
We do not guarantee any specific result. Any results shown on our website belong to the individuals described and are not a promise or a typical outcome. Individual results vary.
5. The 6 Week Challenge and the performance credit
If you enrol in the 6 Week Challenge:
5.1 Payment
You pay the challenge fee up front. The fee is discussed and disclosed on the free 10-minute call before you commit to anything.
5.2 The performance condition
If you achieve either of the following over the six weeks, your challenge fee is credited toward your next program with The Dad Bod Mechanic:
- A loss of 20 pounds or more in body weight, or
- A reduction of 6 inches or more in total, measured across five sites combined
5.3 Measurement
Measurements are taken on Day 1 and Day 42 at five sites: chest, belly, arms, thighs, and glutes. The 6 inch threshold is the combined total of reductions across all five sites, not a reduction at any single site.
You take your own measurements and weigh-in, and you record a video of both on Day 1 and Day 42 as verification. Videos must be submitted through the coaching app. If verification videos are not submitted for both dates, the performance condition cannot be assessed and the credit does not apply.
5.4 What the credit is, and is not
The credit is applied against the purchase price of a subsequent program. It is not a cash refund. No money is returned. If you do not purchase a further program, no value is realised from the credit.
5.5 Expiry
The credit must be applied within 12 months of the end of your challenge.
5.6 Completion and adherence
The credit is earned by completing the six weeks and following the program as prescribed. If you stop partway through, or if you reach the number without following the program, the credit does not apply.
5.7 Relationship to the money-back guarantee
The guarantee in section 8.4 is a refund of money paid. This credit is applied against a future program and is not a refund. If you exercise the 30-day guarantee during a challenge, the challenge ends at that point, you are refunded, and no performance credit arises.
Because the guarantee runs 30 days from your program start and the challenge runs 42 days, the guarantee window closes on Day 30 of the challenge. After Day 30 the challenge continues, but the refund option has passed.
6. In-person coaching and gym membership
In-person coaching takes place at Evolve Strength Royal Oak, #600, 8888 Country Hills Boulevard NW, Calgary, AB T3G 0B6.
HEJI FITNESS, INC. does not own or operate this facility.
In-person coaching requires you to hold your own ongoing Evolve Strength membership. That membership is separate from your coaching fee and is not included in it. You contract with Evolve Strength directly for it, on their terms, and any issue with the facility, its equipment, or its membership is between you and them.
Your coaching fee pays for coaching only.
7. The free trial
After the free 10-minute call, if we agree you are a fit, you receive two complimentary coaching sessions and a one-week trial gym membership at no cost. These exist so both sides can confirm the fit before anyone commits. There is no obligation to continue.
8. Scheduling, cancellation, pausing and refunds
8.1 Cancelling or rescheduling an in-person session
We require 24 hours' notice to cancel or reschedule an in-person session. A session cancelled with less than 24 hours' notice, or missed without notice, is treated as used.
This applies to in-person sessions only. Online coaching has no session cancellation requirement.
8.2 Pausing your coaching
You may pause coaching once per program, for up to one month, for reasons such as injury, illness, or travel. Tell us before the pause begins.
A pause does not extend your program end date. Your program still finishes on its original date, so paused time is time you do not get back.
8.3 Ending coaching
Either side may end the coaching relationship with one month's written notice. Your coaching continues, and remains payable, through that notice period.
8.4 30-day money-back guarantee
If you are not satisfied, you may request a full refund within 30 days of the start of your program. The 30 days run from your program start date, not from the date you paid and not from your first session. Email coach@thedadbodmechanic.com to request it.
8.5 Outside those windows
Beyond the 30-day guarantee period, fees already paid are not refundable, except where required by law.
9. Payment
9.1 Currency
Clients in Canada are charged in Canadian dollars. Clients in the United States are charged in United States dollars. The currency that applies to you is confirmed before you pay.
9.2 Accepted payment methods
- Visa
- Mastercard
- American Express
- Interac e-Transfer (Canadian clients only)
Card payments are processed by Stripe. We never see or store your full card details.
9.3 Payment in full
Programs are paid in full at the outset. Instalment plans are not available.
9.4 Failed or late payments
If a card payment fails, our system automatically attempts the charge again three days later. If that attempt is also unsuccessful, we will contact you to arrange payment.
Interac e-Transfer is a manual payment and is not retried automatically. If an expected e-Transfer does not arrive, we will contact you.
If you believe a payment has failed, email coach@thedadbodmechanic.com so it can be resolved before it affects your coaching.
10. Text messages
If you consent to receive text messages, message frequency varies and message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Consent to messaging is not a condition of purchasing anything from us. See our Privacy Policy for how we handle mobile information.
11. Intellectual property and your material
Programming, meal plans, videos, and written material we provide are for your personal use. Please do not redistribute, resell, or share them.
Your progress photos and measurements belong to you. We will not publish or share them without your separate written consent, given specifically for that purpose. That consent is optional and you can withdraw it.
12. Limitation of liability
To the fullest extent permitted by law, HEJI FITNESS, INC. and Jimmy Hartley are not liable for indirect, incidental, or consequential losses arising from your use of our services or this website. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Nothing here limits liability that cannot be limited by law, including liability for gross negligence or wilful misconduct.
13. Website content
We aim to keep this website accurate and current, but we do not warrant that it is error-free or continuously available. Content is provided for information only and does not constitute medical, nutritional, or professional advice.
14. Changes
We may update these terms. Material changes affecting current clients will be communicated directly. Your continued use of our services after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Disputes are subject to the courts of Alberta.
